The Belgian Capacity Remuneration Mechanism

A CRM or "Capacity Remuneration Mechanism" is an instrument to complement the energy markets with a capacity market that guarantees the availability of sufficient capacity to ensure electricity supply.

As a matter of fact, it is almost impossible to summarize several thousand pages of documents. The aim of this textbook is to give a flavor of the mechanism and incentivize producers, investors and bankers to dive-in, study and profit from the CRM.

A CRM or ‘Capacity Remuneration Mechanism’ is an instrument to complement the energy markets with a capacity market that guarantees the availability of sufficient capacity to ensure electricity supply. It is the base for future adequacy of the energy system after the phase out of nuclear energy.

This market involving auctions for the upcoming years is fully developing since 2021 as eligible capacities were given the opportunity to prequalify for the CRM.

Subsequently, in this example, capacities that prequalified could submit an offer for the CRM auction during a bid submission period as it was conceived by the Belgian authorities.

In order to get a practical tool for investors, lawmakers, lawyers, industrials and shareholders, the publisher decided to add all relevant legal texts (in French and Dutch) involved in the procedure.

Guy Block

Michel Vandersmissen

Michel Vandersmissen a rejoint le département Énergie de Janson en 2008. Il a été nommé associé en 2021.

En tant qu'avocat au Barreau de Bruxelles depuis 2008, il se concentre sur le droit de l'énergie, en particulier la réglementation et la libéralisation des marchés de l'électricité et du gaz.

Michel conseille à la fois les acteurs privés du marché (producteurs, fournisseurs, clients, opérateurs de réseaux, etc.) et les différents régulateurs et autorités au niveau national (fédéral et régional) et international. Il possède notamment une grande expertise dans la rédaction de contrats énergétiques, la rédaction de textes législatifs (lois et décrets d'application) et l'élaboration et la mise en œuvre d'instruments politiques visant à garantir des investissements adéquats dans les capacités de production et de régimes de soutien aux énergies renouvelables (éolien terrestre et offshore, solaire, biomasse, biogaz, géothermie, etc.) et leur compatibilité avec les règles européennes en matière d'aides d'État.
